The Ohio Secretary of State's office has highlighted a potential issue regarding President Joe Biden's access to the general election ballot in Ohio.
In a letter addressed to Ohio Democratic Chair Liz Walters, the office's legal counsel pointed out a conflict in Ohio law concerning the Democratic National Committee's nominating process and the state's deadline for certifying the party's presidential nominee.
As per the letter, which was obtained the Democratic National Convention is set to convene on Aug. 19, which falls more than a week after Ohio's Aug. 7 deadline for certifying a presidential candidate.
This discrepancy could affect Biden's eligibility to be listed on the ballot in Ohio.
To resolve this matter, the Secretary of State's office suggested that the Democratic National Committee either reschedule its nominating convention or that the Ohio General Assembly create an exception to the statutory requirement by May 9, 2024, which is 90 days prior to the effective date of a new law.
In the letter, the office's legal counsel, Paul Disantis, requested a prompt response from the Democratic National Committee or the Ohio General Assembly to ensure compliance with state law.
The Ohio Democratic Party has acknowledged receipt of the letter.
